Licensing

1. Agreement and scope

These standard terms cover the full commercial (enterprise) edition of BluKavantUI for OutSystems, previously branded BluUI, including the modules, source, styles, scripts, and documentation identified in your written license order. “Blutek Media” means the licensor identified in that order; “you” means the licensed person or organization. The order must identify both parties and be accepted by them before a commercial license is granted.

Your order specifies the covered version or edition, permitted developers, organizations, applications and environments, fees, license duration, and any updates or support. An expressly agreed provision in the order takes precedence over conflicting standard terms. Viewing this website or obtaining a copy of the software does not itself grant a commercial license.

2. Permission to use and modify

Subject to payment of the agreed fees and compliance with this agreement, Blutek Media grants you a nonexclusive license to install, inspect, use, and modify the covered software to develop and operate applications within the scope and duration of your order. You may make reasonable backup copies.

Your employees and contractors may access the source only as needed to work on your behalf within that scope. You are responsible for their compliance. They receive no independent right to reuse the commercial components for other customers or projects.

3. Source access and distribution

Native OutSystems packages include editable OutSystems source. Source access lets you inspect and adapt the components for licensed applications; it does not make the commercial edition open source or grant unrestricted redistribution rights.

You may make applications available to end users within the scope of your order. Except as expressly authorized in that order, you may not sell, sublicense, publish, share, or redistribute the commercial modules or their source as standalone components, a component library, a development kit, or a template product. Delivery of editable modules to a client or another organization requires that recipient to be covered by the order or a separate license.

Do not give anyone outside the authorized scope access to the enterprise packages, source, modified copies, or license keys, whether for payment or free of charge. This includes public repositories, shared download links, marketplaces, and private transfers to unlicensed organizations. Access by authorized employees and contractors, and delivery of licensed end-user applications, remain permitted as described above.

Retain copyright, license, and third-party notices in the source and any required distribution materials. Do not remove notices to misrepresent ownership. These restrictions apply to the commercial BluKavantUI material, including modified copies, and do not restrict independently developed code or rights granted under separate third-party licenses.

4. License keys

Blutek Media will issue license keys for the enterprise edition to the licensed person or organization. Keys identify the entitlement granted by your order; possession of a key does not grant additional rights, expand the licensed scope, or transfer the license to another person or organization.

You must keep your license keys valid and current for the use covered by your order. Complete any required license renewal before the agreed expiry date, and apply replacement or updated keys within the period specified in your order or on reasonable written notice from Blutek Media. Keep your licensing contact details current so renewal and replacement notices can reach you. Contact Blutek Media promptly if you need a replacement or cannot complete a required key update.

Protect license keys from unauthorized access. Do not publish, sell, share, or transfer them outside the authorized scope, use another organization’s keys, or bypass any applicable license validation. Share keys internally only with authorized personnel who need them for licensed use. Notify Blutek Media promptly if a key is lost, exposed, or misused so it can be replaced.

Keeping a key current does not require installing the latest BluKavantUI release. Key replacement does not change the scope or duration of the license granted in your order, and expiry of support alone does not end a separately granted perpetual license.

5. Ownership

Blutek Media and its licensors retain ownership of their existing software and intellectual property. You retain ownership of your application code, data, and original contributions. Modifying or incorporating BluKavantUI does not transfer ownership of the underlying BluKavantUI material to you or ownership of your application to Blutek Media. No trademark rights are granted.

6. Free releases and third-party software

The limited free Forge edition is governed by the license included with that specific release, not automatically by these commercial terms. Its permissions apply only to the material distributed in that edition. A free release does not grant rights to the full commercial edition.

Third-party libraries remain governed by their own licenses. Nothing in this agreement removes permissions those licenses grant. Preserve their required notices. OutSystems platform subscriptions and any other third-party entitlements are separate from a BluKavantUI license.

7. Updates, support, and duration

Updates, new versions, support, service levels, and renewal rights are included only to the extent stated in your order. There is no automatic promise of lifetime updates or support. Whether a license is perpetual or time-limited is determined by the order; expiry of support alone does not end a separately granted perpetual license.

You are responsible for testing the software and any modifications in your application, maintaining backups, and managing your data, security, and deployment. Compatibility and accessibility must be assessed in the context of your finished application.

8. Warranties and liability

Except for express commitments in your order and rights that cannot lawfully be excluded, the software and documentation are supplied “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or noninfringement. Blutek Media does not warrant uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, Blutek Media is not liable for indirect, incidental, special, or consequential losses, including lost profits or lost data. Its total liability arising from the affected license is limited to the fees paid for that license. These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited.

9. Breach and termination

Blutek Media may terminate a commercial license by written notice if you materially breach this agreement and do not remedy the breach within 30 days after receiving written notice describing it. A time-limited license also ends when its agreed term expires unless renewed.

When your license ends, stop the use covered by that license and remove the commercial components from your deployments and working copies, except to the extent continued use is expressly permitted by your order or required by law. Ownership, distribution restrictions, key confidentiality, accrued payment obligations, enforcement rights for prior breaches, and applicable warranty and liability provisions survive termination.

10. Unauthorized sharing and legal remedies

Unauthorized sharing, publication, sale, or redistribution of the enterprise edition, its source, modified copies, or license keys is a material breach of this agreement and may also infringe intellectual property rights. Such conduct may result in legal action and liability for damages.

Blutek Media may pursue available legal remedies, including an injunction or other court order to stop unauthorized use or distribution, damages, and recovery of reasonable legal costs and attorneys’ fees to the extent permitted by applicable law and awarded by the relevant court. The availability and amount of any remedy depend on the applicable law and circumstances; this agreement does not impose an automatic fixed penalty.

The notice and cure period for termination does not prevent Blutek Media from seeking urgent court relief or pursuing claims for losses already incurred. Remedying a breach does not by itself release liability for that breach. Nothing in this section limits rights or defenses that cannot lawfully be excluded.

11. Existing rights and changes

The accepted order and the version of these terms incorporated into it form the license agreement. Later website changes do not automatically change an existing agreement or revoke rights already granted under a previous or separate license. Any agreed governing law, dispute process, or additional terms should be recorded in the order. Mandatory applicable law remains unaffected.
